By accessing or using the This Machine platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and This Machine ("we," "our," or "us"). We may update these Terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

This Machine is a collaborative AI workspace platform that provides:

• Claude Machines: Workspaces where you interact with Claude AI
• Isolated Sandboxes: Secure execution environments with persistent file storage
• Real-time Collaboration: Ability to work with team members simultaneously
• Bring Your Own Key (BYOK): Use your own Anthropic API key for AI interactions

The Service is provided on a subscription basis with various tiers offering different levels of compute time and features.

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update any information to keep it accurate
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

4. Your API Keys

Our Service operates on a "bring your own key" model. You are responsible for:

• Obtaining and maintaining valid API keys from Anthropic
• Ensuring your use of API keys complies with Anthropic's terms of service
• All charges incurred through your API key usage
• Keeping your API keys secure and confidential

We encrypt your API keys at rest but are not responsible for any unauthorized use resulting from your failure to maintain key security.

Your use of Anthropic's services through our platform is subject to Anthropic's terms of service and acceptable use policies. You must comply with all applicable Anthropic policies when using the Service.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Transmit malware, viruses, or other harmful code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or its infrastructure
• Use the Service for cryptocurrency mining
• Generate or distribute illegal, harmful, or offensive content
• Circumvent any usage limits or access restrictions
• Resell or redistribute the Service without authorization
• Use automated systems to abuse the Service

We reserve the right to suspend or terminate accounts that violate these restrictions.

6. Intellectual Property

Your Content

You retain ownership of all content you create, upload, or store using the Service ("Your Content"). By using the Service, you grant us a limited license to store, process, and display Your Content solely to provide the Service to you and your collaborators.

Our Service

The Service, including its design, features, and underlying technology, is owned by This Machine and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

7. Third-Party Services

The Service integrates with third-party services including:

• Anthropic: Provides Claude AI capabilities. Your interactions are subject to Anthropic's terms and policies.
• Daytona: Provides sandbox infrastructure for code execution.
• Polar: Handles payment processing and subscriptions.
• Composio: Provides third-party app integrations and connected account capabilities.
• Convex: Our backend database and real-time sync provider.
• here.now: Hosts static sites deployed from your machines.

We are not responsible for the availability, accuracy, or practices of third-party services. Your use of these services may be subject to their respective terms and privacy policies.

8. Payment Terms

Paid subscriptions are billed in advance on a monthly basis. By subscribing, you authorize us to charge your payment method for all applicable fees.

• Subscription fees are non-refundable except as required by law
• You may cancel your subscription at any time; access continues until the end of the billing period
• We may change pricing with 30 days' notice to existing subscribers
• Free tier users receive limited compute hours per month that do not roll over

Compute time is calculated based on active sandbox usage. Unused compute time does not carry over between billing periods.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide advance notice when possible)
• Emergency maintenance or security updates
• Third-party service outages
• Factors beyond our reasonable control

We are not liable for any loss or damage resulting from Service unavailability.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THIS MACHINE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or data loss
• Unauthorized access to your transmissions or data
• Actions of third parties using the Service

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability or fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of AI-generated content
• Uninterrupted or error-free operation

AI-generated content may be inaccurate or incomplete. You are responsible for reviewing and validating any output before use.

12. Indemnification

You agree to indemnify, defend, and hold harmless This Machine and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content or its use

13. Termination

You may terminate your account at any time by contacting us or using the account deletion feature (if available).

We may suspend or terminate your access to the Service at any time, with or without cause, including for:

• Violation of these Terms
• Non-payment of subscription fees
• Conduct harmful to other users or the Service
• Extended periods of inactivity

Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

14. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in California. You consent to the personal jurisdiction of these courts.

15. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and This Machine.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: You may not assign these Terms without our consent. We may assign our rights without restriction.
